Build America, Buy America Overview
The Build America Buy America (BABA) Act, enacted on November 15, 2021, as part of the Infrastructure Investment and Jobs Act (IIJA), strengthens domestic sourcing requirements for infrastructure projects supported by federal financial assistance. Under BABA, covered federally funded infrastructure projects must use iron, steel, manufactured products, and construction materials that meet applicable U.S. production requirements.
BABA and its implementing regulations establish separate requirements for three categories: (1) iron and steel, (2) manufactured products, and (3) construction materials. For certain fiber optic cable products, including drop optical fiber cables, all manufacturing processes must take place in the United States. This includes processes such as initial ribboning, buffering, fiber stranding, and jacketing.
For broadband-related manufactured products, including hubs, terminals, cabinets, and interface devices, the products must be manufactured in the United States. In addition, the cost of components that are mined, produced, or manufactured in the United States must exceed 55% of the total component cost.
